  1. ELIGIBILITY TO USE THE WEBSITE

You must have the legal capacity to enter into a binding contract to place an order through our website.

Customers under 18 years of age should only use the website or place an order with the involvement and permission of a parent or legal guardian.

You agree to provide accurate, complete and current information when placing an order or creating an account.

  1. PRODUCTS AND PRODUCT INFORMATION

Kitchen Bright sells kitchen utensils, bakeware, drinkware, storage products, accessories and other kitchen-related products.

We take reasonable care to display product descriptions, measurements, colours, images, materials and prices accurately. However:

• Colours may appear differently depending on your screen or device.
• Product packaging may change without materially affecting the product.
• Minor variations may occur between product images and the item received.
• Measurements and capacities may be approximate unless stated otherwise.

Nothing in these Terms limits your rights where a product is faulty, unsafe, misdescribed or not reasonably fit for its intended purpose.

  1. PRODUCT AVAILABILITY

All products are subject to availability.

Adding an item to your basket does not reserve it. If a product becomes unavailable after you place an order, we will contact you and provide an appropriate refund for the unavailable item.

We may introduce, modify, suspend or discontinue products at any time. Changes will not affect orders that have already been accepted unless we contact you and agree otherwise.

  1. PRICES, TAXES AND SHIPPING COSTS

Product prices are displayed in the currency selected on the website. Prices may include applicable taxes where required.

Delivery charges and any other applicable fees will be displayed during checkout before you confirm your order.

We may change product prices at any time. Price changes will not affect orders that have already been accepted.

If a product is listed at an obviously incorrect price due to a technical, administrative or typographical error, we may contact you before dispatching the order. You may confirm the order at the correct price or cancel it for a full refund.

  1. PLACING AN ORDER

When you place an order, you are making an offer to purchase the products in your basket.

After receiving your order, we may send an order acknowledgement. This acknowledgement confirms that we have received your order but does not necessarily mean that it has been accepted.

The sales contract is formed when we confirm acceptance or dispatch the products, depending on the information shown during checkout.

We reserve the right to reject or cancel an order before dispatch for legitimate reasons, including:

• Product unavailability.
• Incorrect pricing or product information.
• Failed or incomplete payment.
• Suspected fraud or unauthorised activity.
• Delivery restrictions.
• An error in the order or checkout process.
• A reasonable belief that the order is intended for unlawful resale.

If we cancel an order after receiving payment, we will refund the relevant amount using the original payment method.

  1. PAYMENT

Payment must be made using one of the payment methods available during checkout.

By submitting payment information, you confirm that:

• You are authorised to use the selected payment method.
• The information provided is accurate.
• Sufficient funds or credit are available to complete the transaction.

Payments may be processed by Shopify Payments, PayPal, card networks, digital-wallet providers or other third-party payment providers.

We do not directly store complete payment-card details. Payment providers process payment information according to their own terms and privacy practices.

  1. DELIVERY

We deliver to the destinations made available during checkout.

Available destinations, delivery charges and estimated delivery periods may vary depending on the product, delivery address and shipping method.

Delivery dates are estimates unless we expressly agree to a guaranteed delivery date. Delays may occur because of customs processing, severe weather, carrier disruption, incorrect address information or circumstances outside our reasonable control.

You are responsible for providing a complete and accurate delivery address. Contact us as soon as possible if you notice an error. We cannot guarantee that an address can be changed after an order has entered processing or dispatch.

Risk of loss or damage passes to you when you, or a person nominated by you other than the carrier, physically receives the goods.

  1. DELAYED, LOST OR DAMAGED DELIVERIES

If your order is significantly delayed, appears lost or arrives damaged, contact us at info@kitchenbright76.com with:

• Your order number.
• Your name and delivery address.
• A description of the issue.
• Photographs of damaged products or packaging, where relevant.

We will investigate the matter with the delivery provider and offer the remedy required under applicable law.

You should not refuse or dispose of a damaged product unless we instruct you to do so, except where retaining it would be unsafe.

  1. ORDER CANCELLATION

Contact us as soon as possible if you need to cancel or change an order.

We may be unable to change or cancel an order after it has been processed or dispatched. In that situation, you may need to return the product after delivery.

Nothing in this section limits a consumer’s statutory right to withdraw from an eligible distance contract.

  1. 30-DAY RETURN POLICY

Subject to the conditions below, eligible products may be returned within 30 days after the date on which you receive them.

To request a return, email info@kitchenbright76.com before sending the product back. Include your order number, the item being returned and the reason for the return.

Products returned under the voluntary 30-day return policy must normally be:

• Unused and in resalable condition.
• Complete with all parts and accessories.
• Returned in the original packaging where reasonably possible.
• Accompanied by proof of purchase.
• Free from damage caused after delivery.

You must not send a return to us without first receiving return instructions.

Your statutory consumer rights remain unaffected by this voluntary return policy.

  1. STATUTORY RIGHT OF WITHDRAWAL

Where applicable, consumers purchasing online may cancel an eligible order without giving a reason within 14 days after receiving the goods.

For an order containing multiple products delivered separately, the withdrawal period normally begins when the final product is received.

To exercise this right, send a clear cancellation statement to info@kitchenbright76.com before the withdrawal period expires.

After notifying us, you must return the goods within the legally applicable return period.

Products should only be handled as much as reasonably necessary to establish their nature, characteristics and functioning. We may make a lawful deduction where handling has reduced the product’s value beyond what would normally be permitted in a physical shop.

  1. RETURN SHIPPING COSTS

Unless the product is faulty, damaged, misdescribed or we agree otherwise, you are responsible for the direct cost of returning unwanted products.

We are responsible for reasonable return costs where a product is faulty, damaged on arrival, incorrectly supplied or otherwise does not conform to the sales contract.

Please obtain proof of postage and use an appropriate tracked delivery service. We are not responsible for a return lost before it reaches us where you selected and arranged the return carrier yourself.

  1. RETURN EXCLUSIONS

The right to return or withdraw may not apply to certain products where an exemption is permitted by law, including:

• Products made to the customer’s specifications or clearly personalised.
• Products that deteriorate or expire rapidly.
• Sealed products that are genuinely unsuitable for return for health-protection or hygiene reasons after being unsealed.
• Products inseparably mixed with other goods after delivery.
• Gift cards or digital products after supply has begun with the required consent, where applicable.

An exclusion will only be applied where legally permitted.

  1. REFUNDS

Approved refunds will be issued to the original payment method unless another method is expressly agreed.

Where a statutory withdrawal right applies, the refund will include the price paid and the cost of the least expensive standard delivery option offered at checkout. Additional costs resulting from an upgraded or express delivery option may not be refunded.

We may withhold a refund until we receive the returned goods or you provide acceptable evidence that the goods have been sent back, where permitted by law.

Banks, card issuers and payment providers may require additional processing time after we issue the refund.

  1. FAULTY, DAMAGED OR MISDESCRIBED PRODUCTS

Contact us promptly if a product is:

• Faulty.
• Damaged on arrival.
• Unsafe.
• Incorrectly supplied.
• Materially different from its description.
• Missing essential parts.

Depending on the circumstances and applicable consumer law, you may be entitled to repair, replacement, price reduction or refund.

Our voluntary returns policy does not replace or restrict any mandatory rights relating to faulty or non-conforming goods.

  1. PROMOTIONS AND DISCOUNT CODES

Promotions and discount codes may be subject to additional conditions displayed with the relevant offer.

Unless stated otherwise:

• Discount codes cannot be exchanged for cash.
• Only one discount code may be used per order.
• Codes must be applied before checkout is completed.
• Discounts cannot normally be applied retrospectively.
• Promotions may have expiry dates, geographical restrictions or product exclusions.

We may cancel or refuse a promotion where there is misuse, fraud or an obvious technical error.

  1. CUSTOMER ACCOUNTS

You may be able to create a customer account.

You are responsible for:

• Keeping your login details confidential.
• Providing accurate account information.
• Restricting access to your device.
• Informing us promptly about suspected unauthorised access.

We may suspend or close an account where it is used unlawfully, fraudulently or in material breach of these Terms.

  1. ACCEPTABLE USE

You must not use the website:

• For unlawful, fraudulent or abusive purposes.
• To introduce viruses, malware or harmful code.
• To interfere with the website’s security or operation.
• To collect information about other users without permission.
• To impersonate another person.
• To submit false orders or payment information.
• To infringe intellectual-property, privacy or other legal rights.
• To scrape, copy or reproduce substantial website content without permission.

  1. INTELLECTUAL PROPERTY

The website and its content, including text, graphics, branding, layout, product photographs and design elements, are owned by or licensed to Kitchen Bright and are protected by applicable intellectual-property laws.

You may access and use the website for personal, non-commercial shopping purposes.

You may not reproduce, distribute, sell, modify, republish or commercially exploit website content without prior written permission, except where permitted by law.

Third-party trademarks remain the property of their respective owners.

  1. REVIEWS AND USER CONTENT

Where the website allows reviews, comments, photographs or other customer content, you must ensure that your submission:

• Is accurate and based on genuine experience.
• Does not contain unlawful, defamatory, threatening or discriminatory material.
• Does not infringe another person’s rights.
• Does not contain malicious code, spam or misleading advertising.
• Does not disclose another person’s private information without permission.

You retain ownership of your content. By submitting it, you grant us a non-exclusive, worldwide, royalty-free licence to display, reproduce and use it for operating and promoting our business, subject to applicable law and our Privacy Policy.

We may remove content that breaches these Terms.

  1. THIRD-PARTY SERVICES AND LINKS

The website may contain links to or integrations with services operated by third parties, including Shopify, payment providers, delivery companies and social-media platforms.

Third-party services are governed by their own terms and privacy policies. We are not responsible for third-party websites or services that we do not control.

A link does not necessarily mean that we endorse every statement, product or service appearing on the third-party website.

  1. WEBSITE AVAILABILITY

We aim to keep the website available and secure, but uninterrupted or error-free access cannot be guaranteed.

We may temporarily suspend access for maintenance, security work, technical problems or matters outside our reasonable control.

We are not responsible for minor technical interruptions that do not affect your statutory rights or an accepted order.

  1. LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for:

• Death or personal injury caused by negligence.
• Fraud or fraudulent misrepresentation.
• Deliberate misconduct or gross negligence where applicable.
• Breach of mandatory consumer rights.
• Any other liability that cannot be restricted under applicable law.

Subject to those protections, we will not be liable for losses that were not reasonably foreseeable when the contract was formed or for losses arising from use of products for commercial purposes where the products were sold for personal household use.

You are responsible for following all safety instructions, care instructions, age restrictions and intended-use information supplied with a product.

  1. EVENTS OUTSIDE OUR CONTROL

We will not be responsible for delay or failure caused by circumstances outside our reasonable control, including natural disasters, severe weather, strikes, transport disruption, customs delays, telecommunications failures, cyber incidents, government restrictions or supplier interruption.

This section does not remove any mandatory rights you may have if products are not delivered within the legally required or agreed period.

  1. PRIVACY AND COOKIES

Our collection and use of personal information are explained in our Privacy Policy.

The website uses cookies and similar technologies. Where required, optional cookies will be used according to the choices made through our cookie-consent tool.

  1. CHANGES TO THESE TERMS

We may update these Terms to reflect changes to our services, business practices, technology or legal obligations.

The version published when you place an order will normally apply to that order. Material changes will not retrospectively reduce rights under an existing contract.

The latest version will be published on this page with a revised “Last updated” date.

  1. SEVERABILITY

If any part of these Terms is found to be unlawful, invalid or unenforceable, the remaining provisions will continue to apply.

The affected provision will be interpreted or adjusted only to the minimum extent necessary to make it lawful and enforceable.

  1. NO WAIVER

A delay or failure by us to enforce a provision does not mean that we have waived the right to enforce it later.

  1. GOVERNING LAW AND DISPUTES

These Terms and contracts formed through the website are governed by the laws of Ireland.

If you are a consumer living outside Ireland, you also retain the protection of any mandatory consumer laws applicable in your country of residence.

Nothing in these Terms prevents you from bringing a claim in a court that has jurisdiction under applicable consumer law.

Please contact us first so that we can attempt to resolve any complaint directly.
